Information gathered from third-party sources

To meet our regulatory and legal duties, we perform a background check via Thomson Reuters when you open an account. This system tracks official positive or negative information regarding individuals, allowing us to mitigate risk and ensure the betting industry remains free from criminal activity.

We might gather additional details from external sources, including our business partners, third-party service providers, and public platforms like social media. This allows us to stay compliant with legal mandates, keep your account information current, and tailor our services to better suit your interests while overall improving the user experience.

To keep our platform secure, we occasionally perform extra verification checks. This happens during account setup or later on if we notice any suspicious patterns. In these cases, we rely on professional databases and agencies that specialize in crime prevention and the promotion of responsible gambling. We may also cross-reference public records or social media profiles to confirm details such as your employment or property ownership.

Publicly available information

If you want to learn more about the legal framework surrounding gambling and the specific responsibilities companies like BATERY must uphold, we recommend visiting dedicated Safer Gambling resource websites.

Data sourced from social media platforms

When we need to meet our regulatory and legal duties, we may review your public social media profiles (such as Facebook). This process helps us confirm that the details you've provided are accurate and ensures that our services are being used in a legal and responsible manner.

The reasons and methods behind the use of your personal data

We process your personal data for various purposes, which can be grouped into the following main categories:

  • Essential actions required to fulfill the contract we have with you and to deliver the specific products or services you've signed up for.
  • Necessary steps we must take to remain compliant with applicable laws and government regulations.
  • Tasks required to satisfy the specific conditions of our operating license.
  • Activities that allow us to manage and operate our business smoothly and effectively.
  • Marketing initiatives and promotional activities that we carry out only with your explicit permission.

We are providing this information because the Curaçao General Data Protection Regulation (Ordinance No. 84) grants you specific rights regarding your personal data. These rights may vary depending on the category the data falls into. In the following sections, we explain these categories in detail, the rights associated with them, and how you can practically exercise those rights.

Additional information collected:

Additionally, we may collect the following types of data:

  • Your name, contact info, and the content of your messages if you reach out to us or participate in a contest, offer, or research study.
  • Technical and demographic details, including your IP address and browser type, captured while you are using our services.
  • Specific hardware identifiers, such as your device's unique ID.

  • Interactions on our social media channels, including public forum posts, chat room messages, profile comments, and direct conversations with our staff or other players.
  • Detailed records of your transactions, including deposits, withdrawals, bets, and the payment methods used. We analyze this data continuously to refine and improve our offerings.
  • Any documentation required to prevent and detect financial crimes, such as money laundering or terrorist financing. This may include verifying where your funds come from and auditing specific transactions.
  • Audio recordings of phone calls or transcripts from Live Chat, whether you're contacting support or placing a bet.
  • Data on how you interact with marketing materials sent by us or our partners.
  • Public profile details (like your name and photo) if you choose to log in or communicate with us via a social media account.
  • Data resulting from profile training activities (detailed further below).
  • Verification data obtained from third-party databases to ensure we are meeting legal and regulatory standards.
Meeting our Obligations

Legal and Regulatory Requirements

We operate under a variety of legal and regulatory frameworks that dictate how we handle personal data and how long we must store it. Specifically, as a betting operator, we are regulated by the Gaming Curaçao authority.

We are deeply committed to social responsibility and safer gambling. We proactively monitor for signs of problem gambling so we can step in early, offer support, and guide users toward professional help.

To better recognize the early warning signs of gambling addiction, we analyze anonymized data from users who have chosen to self-exclude—looking at factors like age, location, and betting history. This insight allows us to protect at-risk customers more effectively and provide timely intervention.

Our business is also subject to other laws regarding payment processing and the handling of customer complaints, which may also require us to process or retain your data for specific periods.

Combating Fraud, Money Laundering, and Illegal Acts

When you open an account or place a bet, we verify your identity and run anti-fraud and anti-money laundering checks. We do this by comparing your information against crime-prevention databases and public records. We share relevant data with verification agencies that help identify illegal activity; these agencies may also share that data with other organizations. If necessary, we will provide information to risk intelligence agencies, fraud prevention bureaus, the police, or debt recovery services.

Beyond financial crimes, we constantly monitor our platform to prevent the misuse of our services for activities like match-fixing, event manipulation, or cheating. We use various tools, including cookies, to detect this. If we find evidence of illegal behavior, we will share that information with the appropriate authorities, including law enforcement.

Privacy Rights: Can I opt out of my data being used for these purposes?

This section refers to activities we are legally required to perform to ensure our services are provided responsibly and in accordance with regulatory standards. These measures protect both our customers and our company. Because these checks are mandatory for us to operate, we cannot provide our services if you disagree with these terms. If you do not wish for your data to be used this way, the only option is to close your account and stop using our services.

Optimizing our business operationsRunning our business effectively and efficiently

To run our company effectively, we engage in certain activities based on a 'legitimate interest.' When these activities involve your personal data, we strive to minimize the impact on your privacy. Under data protection laws, you have the right to object to this processing if your privacy concerns outweigh our business needs. While you can exercise this right, these activities are fundamental to how we operate; therefore, objecting to them will generally require you to close your account.

Please review this section thoroughly to ensure you are comfortable with our practices before sharing your personal information with us.

Business Insights

We perform basic data analysis to understand who our customers are, how they use our site, and how our business is performing. This helps us everything from optimizing our ad campaigns to ensuring we have enough support staff during busy hours. By understanding broad demographic trends (like age and location), we can build better, more relevant features and products for our users.

Privacy Rights: Can I opt out of my data being used for these purposes?Privacy Rights: Can I object to having my personal information used in this way?

Like any commercial entity, we must track our performance and customer satisfaction. Since we do this using aggregated, non-identifiable data, your individual privacy is not affected. However, if you are uncomfortable with this level of analysis, you may choose to close your account and stop using our services.

Protecting our commercial interests

While most of our users follow the rules, we monitor betting patterns and account interactions to spot any behavior that violates our Terms and Conditions or threatens our business interests.

We reserve the right to use this data to decide whether to restrict or, in rare cases, terminate an account. These decisions are not made lightly; we consider a wide range of factors, including your account history and data from industry-wide databases. Note that we do not use cookies for this specific type of monitoring.

Privacy Rights: Can I opt out of my data being used for these purposes?Privacy Rights: Can I object to having my personal information used in this way?

We have a legitimate business interest in protecting ourselves from deliberate abuse of our platform. We believe our methods are proportionate to the risks and have a minimal impact on your privacy. If you do not agree with this approach, the only option is to close your account.

Activities based on your consent: MarketingThings we do with your consent: Marketing

We'll only send you updates, offers, and news if you've explicitly told us it's okay. If you have, we might reach out via email, post, SMS, or through our digital platforms regarding any services offered by our group. Your data is safe with us; we never sell or share your information with outside companies for their own marketing purposes. Occasionally, we might partner with a third party to bring you a specific deal we think you'll love, but the communication will always come directly from us. We will never hand over your personal details to a partner without your permission first.

Rest assured that any sensitive data we hold—such as details regarding your health, ethnicity, or self-exclusion status—is strictly off-limits for marketing purposes.

Keeping it Relevant

At BATERY, our goal is to enhance your betting experience. To do that, we want to share features and offers that actually matter to you, rather than generic ads. We achieve this by looking at the information we have—like your age, gender, location, how you use social media, and your interaction patterns with our platform—to create a personalized profile (often called 'Profiling'). We also supplement this by looking at general trends from people with similar demographics to refine our offers and ensure they are truly relevant to your interests.

Putting you in Control

We believe you'll appreciate tailored content over random advertising, which is why we use your profile to customize our marketing. It's a win-win for both you and us. That said, data protection laws give you the right to opt out of this profiling process at any time. Because all our marketing is personalized this way, opting out of profiling means you'll stop receiving all direct marketing from us. You can manage this during sign-up by leaving the marketing box unchecked, or later through your account settings. While this stops emails, texts, and letters, your online experience on our site and apps will still be personalized based on your profile, meaning you'll still see:

  • Custom pop-ups highlighting products and deals we believe you'll enjoy,
  • Tailored offers delivered via on-site content or pop-up notifications,
  • Targeted ads on social media (like Facebook or X/Twitter) and other ad-supported websites. You can easily manage these through the privacy settings of those specific platforms.

We feel this is the fairest balance: you can stop the 'offline' interruptions (email, SMS, post) while still getting a smooth, optimized online experience with all the bonuses and promos. However, if you'd rather not have any personalization online either, you can turn this off in your account details. Just keep in mind that your site experience will feel more generic, and you'll miss out on bespoke bonuses. Also, please note:

  • Some personalized banners are managed by cookies. To stop these, you'll need to adjust your browser's cookie settings, otherwise they will still appear.
  • You might still encounter our general ads while browsing other sites or social media, but these won't be targeted specifically at you.

Handling Sensitive InformationMore sensitive matters: how we use sensitive data

As a responsible gaming provider, we are committed to helping our customers bet safely and encourage the use of our support tools. This means you might occasionally share sensitive details with us—directly or indirectly—regarding your emotional or physical health, or discuss gambling-related struggles. We treat this information with the utmost care and use it solely to provide the support you've requested or to guide you toward professional help.

To improve our safer gambling initiatives, we need to understand the patterns that lead to self-exclusion or signal problem gambling. When a user self-excludes, we analyze demographic data (like age and location) and betting history to identify common risk factors. This allows us to intervene earlier and provide better support to at-risk customers, ensuring we meet our regulatory duties and promote responsible play.

Occasionally, we may receive other sensitive data, such as your nationality or ethnicity, usually as a byproduct of identity verification checks. We rarely ask for this directly; if we do, it's for a specific legal reason which we will explain. If this data appears on an ID document we are required to hold, we will keep it only to satisfy legal or regulatory mandates and will never use it for any other purpose.

Any copies of your passport, driver's license, or national ID are used exclusively for identity verification to ensure we comply with the law and industry regulations.

Other Reasons We May Share Your DataOther circumstances in which we share your personal data

Outside of the processes mentioned above, we do not share your personal info with third parties unless the law requires it. While rare, this might include sharing data with law enforcement, courts, or tax authorities.

In rare cases where we need to defend our legal rights, resolve a dispute, or enforce a contract, we may share necessary data with regulators, legal counsel, or debt recovery agencies.

If our business is sold, reorganized, or restructured, your personal information will be transferred to the new owner so they can continue providing the services you signed up for. Any other specific measures of this nature would only be taken with your explicit consent.

We are committed to handling your personal data legally and with full respect for your privacy, regardless of the reason for sharing. In cases where law enforcement or government agencies request your information, we will not hand anything over unless we are presented with a valid warrant, a court order, or other official legal authorization.

How long do we keep your information?

Your personal information is only kept for as long as there is a legitimate legal justification to do so. This includes the time needed to provide the services you've signed up for, fulfilling our regulatory and legal duties, settling any disputes, and ensuring our agreements are upheld.

The exact duration we store your data varies based on why it was collected, how it's being used, and the specific laws that apply. As a general rule, we will keep your records for at least five years following your last account transaction. Once this five-year window has passed and we have the necessary approval from the Authority, your data may be permanently deleted.

When deciding how long to keep or when to delete data, we consider several factors, including industry standards for gambling, tax laws, anti-money laundering regulations, payment processing rules, and how we handle complaints. We also keep data to prevent fraud and meet audit requirements. Consequently, some of your information must be stored even after you stop being a customer. Once these obligations are met, we dispose of the data securely. Please be aware that if you unsubscribe from our marketing, we still keep your contact details on a 'suppression list' to ensure you aren't contacted again. Please note that if you opt out of receiving marketing from us, we will still need to keep your contact details in order to suppress them from future marketing activity.
